1. Training Policies

  • Down Payment: Your down payment applies to the total balance of the service and is non-refundable.
  • Payments: By enrolling in a Training Plan, you authorize Driveline Baseball to charge your designated payment method for the down payment and for recurring monthly installments for the length of your plan (3-month or 12-month, as applicable). You authorize us to store your payment method securely and to re‑attempt any failed payment. Installments are due monthly on the same day of the month as your training start date (or the next business day). If you believe a charge is incorrect, email [email protected] with details and allow 10 business days to resolve it before contacting your card issuer
  • Athletes must pay for all consecutive months of their plan. This can be done in a combination of in-gym/remote training in accordance to their need/requirements, dating back to their first day of training. Athletes must use their plan length consecutively (3 or 12 months, as applicable) regardless of if they train in gym or remotely.
  • Location and Schedule: Training Plan athletes have access to all active Driveline training facilities subject to capacity and are required to adhere to each facility’s specific schedule. No guarantees are made for availability of any specific training venue or location. Please confirm your schedule with the Support team before making travel arrangements.
  • Assessment: An assessment is intended to be completed at 100% effort. If an athlete has
    not been medically cleared or ramped up to perform at 100% effort, Driveline Baseball
    reserves the right to refuse to complete the assessment.

2. Cancellation and Refund Policies

  • Commitment: Athletes must pay for all consecutive months of their selected plan (3-month or 12-month Training). Plans may be completed in-gym or remotely. There is no early cancellation unless approved by Driveline Baseball under one of the two options below.
  • Early Cancellation Buy-Out (by approval only).
    • Option A — Qualifying Circumstances (by approval only).
      • Upon written request with documentation, Driveline may approve an early cancellation for one of the following athlete  circumstances:
        • Medical inability to train for ≥ 60 consecutive days (physician letter).
        • Permanent retirement from competitive play (written notice to team/league or equivalent).
        • Significant financial hardship (e.g., involuntary job loss or bankruptcy filing; supporting documents required).
        • Material breach by Driveline of core services in your Enrollment Summary, after your written notice and a 15-day opportunity for us to cure (subject to verification).
        • Written misrepresentation of core program features by sales personnel.
      • Notes: “Training staff deems athlete uncompliant” and athlete breach of
        Terms of Service are grounds for Driveline-initiated termination and do
        not create a right to athlete-requested cancellation.
    • Option B — Early Cancellation Buy-Out (by approval only).
      • If you do not qualify under Option A, you may request approval to end your commitment by paying the Early Cancellation Amount:
        • Monthly Installment plans: Early Cancellation Amount = Assessment Price + (Months Used × Monthly Fee)
        • Annual Upfront plans: Early Cancellation Amount = ((Annual Fee − Assessment Price) ÷ 12) × Months Used
      • Definition: “Assessment Price,” “Monthly Fee,” and “Annual Fee” are the amounts on your Enrollment Summary. “Months Used” means any month (partial or full) in which training access was granted (in-gym or remote).
      Process to request cancellation
      • Where to write: Email [email protected].
      • Timing:
        • Option A: Email within thirty (30) days of the qualifying event
          and include required documentation
        • Option B: Email at least ten (10) business days before your next
          bill date to request approval and receive your calculated Early
          Cancellation Amount.
      • Decision: We will approve or deny in writing within 15 business days and may request additional information to verify eligibility.
      • Effective date: Cancellation is effective only when approved and (for Option B) when the Early Cancellation Amount is paid in full. Until then, recurring installments continue under your Payment Authorization.
  • Related policies (apply to all athletes)
    • No refunds for services rendered. If the total you have paid is less than the Early Cancellation Amount, the difference is due immediately. If you have paid more, no refund is issued.
    • Down payments are non-refundable.
    • Remote completion required: If you cannot train in-gym, you must complete your plan remotely; inability to attend in-gym sessions is not a valid reason to cancel.
    • Acceleration on default: If you (a) fail to pay any installment within 15 days of its due date, (b) fail to pay the approved Early Cancellation Amount after giving notice, or (c) initiate a non-fraud chargeback, the remaining unpaid balance of your training plan (as stated in your enrollment summary) becomes immediately due and payable.
    • Athletes must use their plan lengths consecutively (3-month or 12-month)
      regardless of if they train in gym or remotely

3. Pause Policies

  • Athlete circumstances that may require a pause are as follows:
    • Injury with documentation
    • Financial Hardship
    • Unique circumstance approved by staff
  • An athlete may NOT pause their plan if they cannot come in gym, they are to complete their program remotely.
  • When a plan is paused, billing will stop until specified resume date and plan length will
    be extended by the length of the pause.
  • To request a pause to a plan, an athlete must contact [email protected] directly with reason for pause. Pauses will not be approved if they do not fall within policies as stated above. Driveline Baseball reserves the right to refuse a pause request if it does not fall within stated policies.

4. Warranties Disclaimed

  • No Warranties: Services and products are provided “as is,” without warranties of any kind. Liability for damages is limited to the greater of $100 or the amount paid for disputed services/products. This waiver does not cover intentional torts or gross negligence.

5. Health Disclaimer

  • Medical Advice: Driveline Baseball is not a medical organization and does not provide medical advice. Consult a medical professional before starting any fitness regimen.
  • Inherent Risks: Participation in sports activities carries inherent risks, including injury or death. By participating, you assume these risks.
  • Personal Responsibility: You are solely responsible for following staff instructions, using equipment properly, and making sound judgments regarding your readiness and ability to participate.

6. General Conditions

  • Accuracy of Information: We are not responsible for inaccurate, incomplete, or outdated information on our site. Material is provided for general information only.
  • Modifications: We reserve the right to modify site content and services. Changes to services or prices will be communicated in a timely manner.

7. Data Usage

  • Personal Information: We collect, store, and use personal and training-related data. Data may include name, email, address, phone number, and credit card information.
  • Training Data: Training data is anonymized before storage and may be used for commercial purposes. We do not sell personal identifiers.
  • Marketing Data: We may use tracking information for targeted ads.
  • Privacy Compliance: We comply with all relevant privacy laws, including HIPAA.

8. Indemnification

  • Indemnity: You agree to indemnify and hold harmless Driveline Baseball and its affiliates from any claims arising from your breach of these Terms of Service or violation of any law or third-party rights.

9. Governing Law

  • Applicable Law: These Terms of Service by the respective state laws.

10. Physical Therapy Services

  • Treatment Consent: By agreeing to treatment, you consent to being screened, evaluated, and treated by our Providers. You have the right to refuse any treatment at any time.
  • Risks and Benefits: Physical therapy carries risks including soreness, joint dysfunction, and in rare cases, severe injury. Benefits include improved health and performance.
  • Alternative Treatments: You acknowledge the availability of alternative treatments and consent to the proposed treatment plan.
  • Communication: You authorize the disclosure of necessary health information to Driveline Staff to ensure coordinated care.
  • Remote Guidance: Online rehabilitation guidance is not a substitute for formal medical evaluation. Always consult local healthcare providers for personalized care.

11. PtEverywhere Account

  • Authorization: By signing this document, you authorize the creation of a PtEverywhere account using your provided information. This account will facilitate treatment plans, appointment scheduling, communication, and other related services.
  • HIPAA Compliance: Your personal and medical information will be stored and managed in accordance with HIPAA regulations and the privacy policies of PtEverywhere.
  • Convenience: The account is for your convenience and to enhance the coordination of your care. Ensure your information is accurate and up-to-date for effective communication and service delivery

12. Minor and Legal Guardian

  • Minor Consent: If the participant is under 18, this agreement must be read and signed by a parent or legal guardian, who assumes the outlined risks on behalf of the minor.

Checking any “I Agree” box, typing your name, or signing electronically is your electronic signature. You consent to our keeping electronic copies of this Agreement and your acceptance, which we may provide to your card issuer in the event of a dispute.
